An initial assessment of the independence of the judiciary under the ‘one roof’ system
It has been twenty years since the Indonesian Supreme Court implemented a ‘one-roof’ system. A system that has been fought for a long time and is believed to be able to guarantee independent judicial power better and be free from interference from both political and economic powers.
The one-roof system is claimed to be more capable of ensuring that court institution is free from interference from parties outside the court. It reflects the respect to the principle of separation of powers in a democratic state. However, its effectiveness in guaranteeing individual autonomy of judges and preventing intervention within the court environment itself still needs to be questioned and revisited.
